Terms and Conditions of Hire for Skinner ApS / skinnerudlejning.dk
Applicable to both private consumers and business customers
These Terms and Conditions of Hire apply to any hire agreement entered into with Skinner ApS, Rosbjergvej 4, 4160 Herlufmagle, Denmark, CVR no. 35818437, telephone +45 41777666, e-mail kontakt@skinnerudlejning.dk, unless otherwise agreed in writing.
By booking, ordering, collecting, receiving or using equipment via skinnerudlejning.dk, e-mail, telephone or any other channel, the hirer accepts these Terms and Conditions of Hire.
For consumers, these terms apply subject to any mandatory provisions of Danish law.
1. General
1.1. Owner / Lessor means Skinner ApS.
1.2. Hirer means the person or company stated in the order or agreement.
1.3. Equipment means all hired machines, vehicles, tools, trailers, lifts, accessories, keys, documents and other hired items.
1.4. These terms apply to both private consumers and business customers.
2. Booking, prices and payment
2.1. A hire agreement is only binding once Skinner ApS has confirmed the booking or once the equipment has been handed over.
2.2. Prices shown on skinnerudlejning.dk are inclusive of VAT. Any special offers, quotations or manually prepared business quotes may be stated differently, where clearly specified.
2.3. Hire charges are payable in advance unless otherwise agreed in writing.
2.4. Skinner ApS is entitled to require a deposit or reserve an amount on the payment card as security for hire charges, non-return, late return, cleaning, refuelling, damage, fines, charges, missing accessories, administration and any other claims arising from the hire.
2.5. By entering into the agreement, the hirer authorises Skinner ApS to offset or charge documented costs and agreed fees arising from the hire.
2.6. In the event of obvious pricing errors, typographical errors or system errors, Skinner ApS is entitled to cancel or correct the booking within a reasonable time.
3. Hire period
3.1. The hire period runs from the agreed collection or delivery time and ends only when the equipment has been duly off-hired and returned as agreed.
3.2. Off-hire may take place via the customer account, e-mail, telephone or SMS, unless otherwise agreed.
3.3. If the equipment is returned later than agreed, Skinner ApS is entitled to charge additional hire for the commenced excess period together with any related costs.
3.4. Where no specific return time has been agreed, the equipment must be returned no later than 08:00 on the next business day. Any delay will be charged as at least one extra day of hire.
3.5. Where Skinner ApS applies a daily hire based on normal operating time, the equipment may generally be used for up to 7.5 hours per hire day unless otherwise stated or agreed.
4. Delivery, collection and transport
4.1. Equipment shall be collected from and returned to Skinner ApS’ address unless otherwise agreed.
4.2. Where delivery or collection is carried out by Skinner ApS, charges will apply in accordance with the current rates.
4.3. The hirer is liable for costs arising from incorrect address details, absence on site, waiting time, failed delivery, insufficient access conditions or other circumstances at the delivery location not attributable to Skinner ApS.
4.4. Responsibility for correct loading, securing, unloading and handling rests with the hirer unless Skinner ApS has expressly undertaken such task.
5. Condition of equipment at handover
5.1. Equipment is handed over in operational condition following normal preparation.
5.2. The hirer must inspect the equipment immediately upon receipt and before use, including its condition, operation and any defects.
5.3. Any objections regarding visible defects, deficiencies or damage must be reported to Skinner ApS immediately and before the equipment is put into use. Failing this, the equipment shall be deemed to have been received in contractual condition unless otherwise documented.
6. Use of equipment
6.1. The equipment may only be used for lawful purposes, correctly and carefully, in accordance with the manufacturer’s instructions, any guidance issued by Skinner ApS and applicable law.
6.2. The hirer is responsible for ensuring that all users of the equipment have the necessary qualifications, certificates, permits and driving licences.
6.3. The equipment may not be lent, sub-hired, transferred to a third party or used by anyone other than the hirer or the hirer’s employees without the prior written consent of Skinner ApS.
6.4. The equipment may not be used outside Denmark without the prior written consent of Skinner ApS.
6.5. Unlawful, improper or grossly negligent use entitles Skinner ApS to terminate the hire agreement immediately and require return of the equipment at the hirer’s expense.
7. Maintenance, repair and downtime
7.1. The hirer may not, without prior written consent from Skinner ApS, carry out repairs, modifications, alterations, fault-finding, servicing or other interventions on the equipment.
7.2. If the hirer instructs a third party without approval from Skinner ApS, this shall be entirely at the hirer’s own cost and risk.
7.3. Any loss arising from unauthorised repair, improper intervention or use of an unauthorised workshop shall be borne in full by the hirer.
7.4. In the event of faults, breakdown or damage, Skinner ApS must be contacted immediately. Equipment with serious faults must not continue to be used until approved by Skinner ApS.
7.5. If downtime is caused by circumstances attributable to the hirer, including misuse, overloading, lack of maintenance or damage, hire charges will continue until the equipment has been repaired or replaced.
8. Hirer’s liability, risk, damage and theft
8.1. The hirer bears the risk for the equipment from handover until proper return.
8.2. The hirer is liable for any damage, loss, theft, vandalism, misuse, overloading, improper transport, inadequate storage or other deterioration occurring during the hire period.
8.3. In the event of theft, fire, vandalism, accident or other serious damage, the hirer must immediately contact Skinner ApS and, where relevant, report the matter to the police without undue delay.
8.4. Upon request, the hirer must provide documentation, including photographs, police reports and other relevant information.
8.5. In the event of loss, total loss or failure to return the equipment, the hirer is liable for the full replacement value of the equipment, less any documented residual or scrap value.
8.6. Loss of or damage to keys, documents, remote controls, charging cables, number plates, accessories and similar items shall be paid for by the hirer.
9. Cleaning, fuel and consumables
9.1. The hirer shall bear the cost of fuel, oil, lubricants, electricity, AdBlue, washing, cleaning and other consumables unless otherwise agreed.
9.2. Equipment and vehicles must be returned in a cleaned condition and with at least the same fuel level as at handover, and at a minimum fully refuelled where this was the case at handover or has been specifically agreed.
9.3. If the equipment is not returned in the agreed condition, Skinner ApS is entitled to arrange cleaning, refuelling or topping up and invoice the hirer for:
the actual consumption used,
time spent,
any transport/driving,
and administration in accordance with the current rates.
9.4. Incorrect, dyed, tax-exempt or otherwise unauthorised fuel or fluids must not be used in the equipment.
9.5. Smoking in vehicles and operator cabins is prohibited. Additional cleaning and odour removal will be charged separately.
10. Special terms for vehicles, traffic offences and reckless driving
10.1. For the hire of vehicles, trailers and other registered equipment, the hirer is responsible for ensuring that the driver holds a valid driving licence and meets all legal requirements.
10.2. The hirer is liable for all fines, parking charges, bridge tolls, road tolls, environmental charges, seizure-related costs, roadside assistance costs and any other public or private charges arising during the hire period or from use during the hire period.
10.3. If a vehicle or other equipment is used for reckless driving of a kind that may lead to confiscation under Danish law, drink-driving, drug-driving, driving while disqualified, other gross or dangerous road traffic offences, or otherwise results in seizure, confiscation, detention or deprivation of possession by the authorities, the hirer shall be fully liable for any loss suffered by Skinner ApS as a result.
10.4. The hirer’s liability under clause 10.3 includes, but is not limited to, the value of the vehicle or equipment, depreciation, loss of hire income, transport, legal costs, fees, administration, third-party claims and any other consequential costs.
10.5. The hirer shall indemnify and hold Skinner ApS harmless against any claim, loss or expense arising from the circumstances referred to in clause 10.3.
10.6. Driving or use outside Denmark requires prior written approval from Skinner ApS. In such case, the hirer bears full responsibility for legal requirements, tolls, insurance, roadside assistance, repatriation and any associated costs.
11. Insurance
11.1. Unless otherwise agreed in writing, no specific insurance cover is included other than mandatory statutory cover.
11.2. The hirer is advised to ensure that their own liability insurance, business insurance, contract works insurance or other relevant insurance is adequate.
11.3. The hirer remains liable for damage and loss in accordance with these Terms and Conditions of Hire, whether or not the hirer has insurance.
12. Changes, cancellation and non-attendance
12.1. Changes to bookings or hire periods are only valid when confirmed in writing by Skinner ApS.
12.2. Skinner ApS may charge a fee or recover documented costs in connection with changes, rebooking, cancellation, failed delivery or non-attendance.
12.3. Reserved services requiring attendance, including instruction, delivery, setup, collection or other specifically booked capacity, may be charged in full if not cancelled in due time.
13. Breach
13.1. In the event of breach by the hirer, Skinner ApS is entitled, without notice, to terminate the agreement and require the equipment to be returned or collected at the hirer’s expense.
13.2. Breach includes, but is not limited to:
non-payment,
late return,
unlawful use,
improper use,
unauthorised lending or sub-hire,
unauthorised repair or alteration,
failure to report damage, theft or intervention by the authorities.
14. Liability of Skinner ApS
14.1. Skinner ApS shall be liable in accordance with mandatory Danish law.
14.2. Skinner ApS shall not be liable for indirect or consequential loss, including operating loss, loss of profit, loss of time, liquidated damages, loss of contracts, production loss or any other consequential loss suffered by the hirer or third parties, unless otherwise required by mandatory law.
14.3. Skinner ApS shall not be liable for delay, breakdown or downtime unless caused by wilful misconduct or gross negligence on the part of Skinner ApS.
15. Personal data
15.1. Skinner ApS processes personal data to the extent necessary to perform the hire agreement, handle payment, customer service, statutory bookkeeping, documentation and possible debt recovery.
15.2. Personal data is processed in accordance with applicable data protection law and Skinner ApS’ privacy policy.
16. Governing law and disputes
16.1. The hire agreement shall be governed by Danish law.
16.2. Any dispute with business customers shall be submitted to the Court in Næstved, Denmark, unless mandatory law provides otherwise.
16.3. For consumers, the venue rules and other rights provided by mandatory law shall apply.
17. Changes to these terms
17.1. Skinner ApS reserves the right to update these Terms and Conditions of Hire.
17.2. The version in force from time to time will be available on skinnerudlejning.dk and shall apply to bookings entered into after publication.
